I was sold fake silver is there anything I can do?

Hi, I wanted to buy a silver chain and I found a private seller who wanted to sell me his old one. I met with him and looked at it. It was printed 925 sterling an he told me he bought it from a jewelry store and told me it was tested real silver. I have to persons full name, email, phone number. Is their anything I can do to get my money back? Thanks for the help. I live in NC if you know the laws here, I do not want him arrested but maybe if I explain the law to him he will willingly pay me back.
